Not everyone present in the U.S. can adjust. Unlawful entry, certain status violations, and missing immigrant visa availability can block the filing. Who Qualifies for Adjustment of Status

You may be able to file Form I-485 if: Filing I-485 when you are not eligible can waste fees and create a record that complicates later filings. Eligibility review comes first.

  • **Immigrant category is available:** An immigrant visa is immediately available (immediate relative) or your priority date is current under the chart USCIS is using
  • **Inspected and admitted or paroled:** In many family cases you must have been lawfully admitted or paroled (limited exceptions exist, such as certain 245(i) grandfathering — fact-specific)
  • **Underlying petition:** You have an approved or concurrently filed immigrant petition (such as I-130) that supports your category
  • **Admissibility:** You are not barred by criminal, health, security, or other grounds — or you qualify for a waiver
  • **Proper status history:** Your entries, overstays, and prior applications are disclosed and analyzed before filing
