You received a Request for Evidence (RFE) or a Notice of Intent to Deny (NOID) from USCIS — and the clock is running. These notices are not a denial, but they are a warning that the officer does not yet see enough in the record to approve. A late, incomplete, or off-point response can end the case. Officers may also deny some filings without issuing an RFE or NOID at all, which makes a complete first filing and a complete response when you do receive a notice even more important.     How Long Do I Have to Respond?

    The deadline is the date printed on your notice — not a generic 12-week assumption. Some RFEs still allow up to 12 weeks; many NOIDs and some RFEs allow far less. Policy changes can also affect whether an officer issues a notice at all before denying. We check the deadline on your document and current USCIS practice for that form type rather than quoting one fixed timeline. Missing the date can result in a denial based on abandonment or on the existing record.
